1. Introductory Provisions

1.1. These General Terms of Use (hereinafter referred to as the “Terms”) govern the rules for using the SuperHome.cz online portal (hereinafter referred to as the “Website”).

1.2. The administrator and operator of the Website is the entrepreneur Rostyslav Antsyferov, Company ID: 11766662, with registered address at Jeremiášova 2722/2a, 155 00 Prague 13-Stodůlky, Czech Republic (hereinafter referred to as the “Administrator”).

1.3. By using the Website, the user (“User”) confirms that they have read and agree to these Terms. If the User does not agree with these Terms, they must stop using the Website.

2. Purpose and Functions of the Website

2.1. The SuperHome.cz Website serves as an informational portal focused on real estate in the Czech Republic.

2.2. Through the Website, Users have the following options:

  • to browse property listings for sale, rent, and other real estate transactions;
  • to publish their own listings (both by private individuals and real estate agencies);
  • to create pages for services related to real estate (for example legal, renovation, or architectural services).

2.3. The Administrator provides only a technical platform for publishing information. The Website is not a broker, agent, representative, or participant in any transactions between Users.

3. Registration and User Account

3.1. Browsing the Website is possible without registration.

3.2. Registration is required in order to publish a listing or create a service page.

3.3. When registering as a private individual, the User must provide their first name, last name, email address, and password.

3.4. When registering as a real estate agency, the agency name and company registration number must also be provided.

3.5. The User is obliged to provide accurate, complete, and up-to-date information.

3.6. The User is responsible for maintaining the confidentiality of their login credentials, must not share them with third parties, and in case of suspected misuse of the account must immediately inform the Administrator.

4. Publishing Listings and Content

4.1. After registration, private individuals may create listings manually.

4.2. Real estate agencies may publish listings either manually or through import from external software (for example SoftReal or Urbium).

4.3. The User guarantees that the published information complies with the applicable legislation of the Czech Republic and does not violate copyright, third-party rights, public order, or good morals.

4.4. It is prohibited to publish content containing false or misleading information, advertising unrelated to real estate, or pornographic, extremist, discriminatory, or offensive material.

4.5. If the User is registered as a real estate agency, they agree that listings exported to SuperHome.cz may be automatically translated into other languages supported by the Website using machine translation. Such translation is provided solely for informational purposes, and the Administrator is not responsible for the accuracy of automated translations.

4.6. The Administrator reserves the right, without prior notice, to modify, temporarily hide, or remove any listings or user accounts that violate these Terms or applicable laws.

5. Liability

5.1. The Administrator is not responsible for the accuracy, completeness, timeliness, or truthfulness of listings published by Users.

5.2. Full responsibility for the content of listings, including texts, photographs, contact details, and prices, lies solely with the User who published them.

5.3. The Administrator does not guarantee uninterrupted or error-free operation of the Website and is not responsible for temporary outages, data loss, or service unavailability.

5.4. The Administrator shall not be liable for any direct or indirect damages, loss of profit, loss of data, or other harm arising in connection with the use or inability to use the Website.

5.5. The User uses the Website entirely at their own risk.

5.6. The Website operator does not verify whether Users are authorized to perform real estate brokerage or any other business activities. The User is responsible for ensuring that they are legally authorized to offer properties, provide related services, or act as a real estate intermediary in accordance with the applicable laws of the Czech Republic.

6. User Rights and Obligations

  • The User must use the Website in accordance with the law and these Terms.
  • The User must not interfere with the technical operation of the Website.
  • The User must not use the Website to distribute spam, commit fraud, or collect data about third parties.
  • The User acknowledges that the Administrator may temporarily or permanently restrict access to an account or listing in case of suspected violation of these Terms.
  • The Administrator may change the functionality of the Website without prior notice.
  • The Administrator may perform technical maintenance that may temporarily limit access to the Website.

7. Paid Services

7.1. Currently, all services are provided free of charge.

7.2. If paid features are introduced in the future (for example listing promotion, advertising packages, or PR articles), the payment terms, refund rules, and service conditions will be published in an updated version of these Terms, and Users affected by the change will be notified at least 45 calendar days in advance.

8. Intellectual Property

8.1. All texts, logos, graphic elements, photographs, design, and other materials on the Website are protected by copyright and belong to the Administrator or other authorized persons.

8.2. Copying, distributing, or otherwise using Website materials without the Administrator’s consent is prohibited.

8.3. By publishing content on the Website, the User grants the Administrator a non-exclusive license to use such content for the purposes of operating and promoting the Website.

9. Personal Data Protection and Cookies

9.1. The Administrator processes Users’ personal data in accordance with the Privacy Policy published on the Website.

9.2. By registering and using the Website, the User agrees to the processing of their personal data.

9.3. The Website may use cookies and other technologies to ensure proper functionality and analyze website traffic.

10. Changes and Termination of the Website

10.1. The Administrator reserves the right to modify or discontinue the Website, its individual functions, or sections at any time.

10.2. The Administrator is not obliged to inform Users in advance but may publish a relevant notice on the Website.

11. Changes to the Terms

11.1. The Administrator reserves the right to modify these Terms.

11.2. The new version of the Terms becomes effective on the date it is published on the Website.

11.3. By continuing to use the Website after the Terms have been changed, the User expresses their agreement with the new version.

12. Governing Law, Dispute Resolution and Contact

12.1. These Terms are governed by the laws of the Czech Republic.

12.2. The parties will attempt to resolve any disputes amicably. If this is not possible, the competent court of the Czech Republic according to the Administrator’s registered office shall have jurisdiction.
